What difference does it make?
Touching people (1) against their will, (2) in a way they do not wish to be touched, and (3) without their approval are all considered consent violations.
Do yourself and others a favor and don’t try to find the “Is this legally prosecutable?” line.
Choosing NOT to find that line and honoring everyone’s touch comfort levels will save you and the other people you encounter from ever having to answer that question.
Do you see how simple this makes everything? If you start by respecting people’s boundaries, then the only people who try to find gaps in the law in order to give themselves cover “out” themselves as the harrasers, assaulters, and violators that they are.
